The official website of the Shanghai Municipal Market Supervision Bureau shows that Shanghai Dihu Intelligent Technology Co., Ltd. was fined 50,000 yuan by the Shanghai Songjiang District Market Supervision Bureau for using advertisements that devalued the products of other producers and operators, and was ordered to immediately correct the problem and stop publishing advertisements.
It is understood that this video advertisement was released in April 2022. The content of the administrative penalty decision shows that the party, as an advertiser and new energy vehicle operator, has released video advertisements such as "Real Hammer Brake Failure", "ARCFOX Endurance Comparison", and "ARCFOX Appearance Comparison" on the established WeChat video account "ARCFOX Shanghai Expo Source" and Douyin account "ARCFOX Shanghai Expo Source Store" since March 31, 2022.
Among them, the parties’ illegal acts of publishing video advertisements containing content such as "Tesla staff was driving, with obvious leg movements, and the brakes failed...," "Tesla Model 3 range: 458km; Tesla Model 3 actual mileage: 200km;...beating a number of new energy vehicles" and "Arcfox appearance comparison, how good is Tesla's interior?" violated Article 13 of the Advertising Law, which stipulates that "advertising shall not devalue the goods or services of other producers and operators."
Therefore, in response to the above-mentioned illegal acts of the parties, the Shanghai Songjiang District Market Supervision Administration decided to order the parties to immediately correct and stop publishing advertisements, and impose a fine of RMB 50,000 in accordance with the relevant provisions of the "Administrative Penalty Law of the People's Republic of China" and the "Advertising Law of the People's Republic of China".
